𝄋 My services do not apply to the work-for-hire copyright law; I am the primary holder of copyright over any and all works unless explicitly stated
𝄋 All services are digital-only files and it is the artwork’s "Intellectual Property" that is purchased by you, the client. No physical item is to be shipped.
𝄋 By paying for my services, clients wholly and unequivocally understand and accept the full extent of my terms of service, including usage permissions. I am not responsible for the client's misunderstanding of my terms of service.
𝄋 Clients are responsible for informing gift recipients of the usage permissions listed below. Gift recipients are held to the same usage permissions as clients.
𝄋 Clients are responsible for any violations done by their gift recipient.Violators (both clients and gift recipients) may be blacklisted indefinitely and without warning.

For the context of my terms and conditions,
— First pass: Sketch stage of tailored commissions.
— Second pass: Colour stage of tailored commissions.
— Crucial revisions: details considered integral to the character's design, such as: eye colour; scars; etc
— Major revisions: adjustments that require intensive redrawing, such as: arm placement; changing expression; etc
— Minor revisions: adjustments that require quick work, such as: increasing contrast of overall work; changing the watermark placement; etc
— Minor filters: a digital image effect below 50% opacity
— Credit: including a clear, visible mention of my username and/or link to my carrd/social media
— Personal website: sites including (but not limited to): toyhouse; VGen character profiles; carrd; etc
— Personal use/display: usage that does not involve financial gain, digitally or physically, including (but not limited to): social media icon; printing; phone wallpaper; etc
— Commercial use: usage that involves financial gain, digitally or physically, including (but not limited to): active display on monetized streams; selling physical/digital copies for physical/digital currency; etc

payment, revisions, refunds

ALL SERVICES
𝄋 Payment is accepted via VGen. Digital currency (bitcoin, FFXIV gil) or exposure is not accepted as forms of payment
𝄋 Full payment required upfront. Payment plans are available for commissions CAD200+
𝄋 Clients will be informed beforehand if they make a request or decision that will incur additional fees. Fee will be waived if there was a failure to inform the client
𝄋 I reserve the right to refuse to issue a refund for any reason.SURPRISE/SKEB
𝄋 Crucial and minor revisions are free
𝄋 Major revisions require a fee starting at CAD$10
𝄋 The exclusion or simplification of details that were not specified to be included or drawn a certain way does not count as a mistake
𝄋 No refunds unless: the work is incomplete by the deadline listed on its respective VGen application, including extended deadlines, after which you are entitled to a refund excluding VGen and Paypal fees.TAILORED
𝄋 20% cancellation fee for refund request (excluding VGen and Paypal fees) at first pass.
𝄋 50% cancellation fee for refund request (excluding VGen and Paypal fees) at second and third pass
𝄋 During first/second pass, all revisions are free if it does not require a complete redo. Complete redos are free up to a total of 5 at each stage. Additional redos will cost CAD$10 each
𝄋 Changes to the previous stage (eg. composition revision during colour layout) will incur fees starting at CAD$10
𝄋 Once the work is complete, crucial and minor revisions are free. Major revisions require a fee starting at CAD$10
𝄋 Failure to reply within 7 days at any stage of a tailored commission will result in a full cancellation, and no fees will be refunded. Please inform me if you will be unavailable for an extended period of time. But life happens! If you return in the future and I still have the file, I will continue with an adjusted deadline.

NDA

There is a minimum CAD$100 NDA (Non-Disclosure Agreement) fee.𝄋 Length of NDA may vary from 1-5 years
𝄋 NDA may be terminated immediately and without warning if client violates my terms and conditions

artist's usage

- I may upload (public file only) onto social media
- I may not use or produce for personal purposes
- I may not use for monetary profit, commercial or private
- I may display private file in portfolio without reference to client
- I may not claim ownership over designs provided by the client including but not limited to: characters; weapons; tattoos; etc
- I may claim ownership over designs I originate for the purpose of the commission and may alter or repurpose them for other work
- I may use and edit public and private files slightly (cropping, minor filters) for the purpose of commission advertisements, with or without watermark

CLIENT'S USAGE

PUBLIC FILE
- You may upload and display publicly on social media and personal websites with or without credit
- You may use as personal display with or without creditPRIVATE FILE
- You may produce 1-10 physical items for personal use
- You may use as personal display with or without credit
- You may upload the full image to personal websites with credit.
- You may not upload the full image to social media websites or applications without credit. You may post publicly on social media if cropped by at least 50% with visible credit.PROHIBITED USAGE
- Do not turn into NFT
- Do not use work-in-progress materials in any way
- Do not sell for any type or any amount of currency
- Do not edit the material in any way other than cropping, resizing, and minor filters
- Do not upload to, reference, or use as source for generative AI programs, websites, or applications
- Do not use in sponsorships or paid promotion/endorsement
- Do not use the material for commercial use without permission
- Do not trace over or recreate my artwork in any way, including use of the artwork as a “base.”
